1. Who Is Responsible for Your Data (Controller)

We have not appointed a Data Protection Officer, as we are not required to do so; you can direct all privacy questions to the contact above.

This Policy applies to our European store, which serves the EU, EEA, United Kingdom, Switzerland, and Norway. Customers of our United States store are served by Remco Tools LLC under a separate privacy policy at https://www.remcotools.com/pages/privacy-policy.

This Policy describes how we process your personal data and the rights you have. It is an information notice under Articles 13 and 14 GDPR — it is not a contract, and using the Site does not constitute consent to processing. Where we rely on consent, we ask for it separately.

2. What Data We Collect

Data you provide:

  • Account and order data — name, email address, billing and delivery addresses, phone number, order history, and VAT/tax ID for business customers. Payment card numbers are processed directly by our payment providers; we never receive or store your full card number.
  • Communications — the content of your emails, chat messages, or calls with us, including withdrawal notices and warranty claims.
  • User-generated content — product reviews, photos, or other content you submit.

Data collected automatically:

  • Device and usage data — IP address, browser type, operating system, referral URLs, pages visited, and timestamps.
  • Cookies and similar technologies — we place non-essential cookies (analytics, advertising) only with your consent, which you can give, refuse, or withdraw at any time via our cookie banner and settings. See our Cookie Policy at https://eu.remcotools.com/pages/cookie-policy.

Data from third parties:

  • Delivery status from carriers, payment confirmation from payment providers, and aggregated campaign data from analytics and advertising platforms.

Where we rely on legitimate interests, we have balanced those interests against your rights and freedoms. You can request more information about this balancing, and you can object at any time (Section 8).

Automated decision-making. We do not make decisions based solely on automated processing that produce legal or similarly significant effects for you. Payment providers may perform automated fraud screening under their own responsibility.

If you do not provide data required to process an order (e.g., a delivery address), we cannot conclude or perform the contract.

4. Who Receives Your Data (Processors and Recipients)

We do not sell your personal data. We share it with:

  • Shopify — hosts our online store and processes order, account, and device data on our behalf.
  • Sufio — generates legally compliant invoices for EU/EEA orders, processing your name, address, order details, and VAT/tax ID where applicable. Sufio processes this data within the EU.
  • Payment providers — process your payment independently as separate controllers for payment execution and fraud prevention.
  • Carriers and fulfillment providers — receive your name, delivery address, and contact details to deliver your order.
  • Email, analytics, and marketing tools integrated with our store, acting on our behalf under data processing agreements. Google, Brevo.
  • Advisers and authorities — lawyers, accountants, and auditors under confidentiality; public authorities where the law requires disclosure.
  • Corporate transactions — in a merger, acquisition, or asset sale, data may be transferred with appropriate safeguards; your rights under this Policy continue to apply.

We have data processing agreements (Art. 28 GDPR) in place with our processors.

5. International Data Transfers

Some of our providers, including Shopify, process data on servers in the United States or Canada. Where personal data is transferred outside the EEA, we rely on:

  • Adequacy decisions of the European Commission (Canada holds one for commercial organizations; U.S. providers certified under the EU-U.S. Data Privacy Framework are covered by the U.S. adequacy decision); and/or
  • Standard Contractual Clauses (SCCs) with supplementary measures where needed.

For UK customers, we rely on the UK's adequacy regulations, the UK Extension to the Data Privacy Framework, or the UK International Data Transfer Addendum to the SCCs, as applicable. For Swiss customers, we rely on the equivalent Swiss mechanisms under the FADP. You can request a copy of the relevant safeguards via info@remcotools.com.

6. How Long We Keep Your Data

  • Invoices and accounting records — 10 years as required by Belgian accounting and VAT law;
  • Order and contract data — for the duration of the contract and until expiry of the legal guarantee and limitation periods;
  • Account data — while your account is active or until you request deletion;
  • Marketing data — until you withdraw consent or object, plus a suppression record to honor your objection;
  • Cookie data — for the lifetimes stated in our Cookie Policy;
  • Correspondence — as long as needed to handle your request and for applicable limitation periods.

After these periods, we delete or anonymize the data.

7. Security

We apply appropriate technical and organizational measures (Art. 32 GDPR), including encryption in transit, access controls, and secure hosting through our providers. Payment processing is PCI-DSS compliant through our platform and payment providers. No system is completely secure; if a personal data breach occurs that risks your rights and freedoms, we will notify the supervisory authority and, where required, you, in accordance with the GDPR.

8. Your Rights

You have the following rights under the GDPR (and, for UK and Swiss customers, the equivalent rights under the UK GDPR and Swiss FADP):

  • Access (Art. 15) — obtain confirmation and a copy of your personal data;
  • Rectification (Art. 16) — correct inaccurate or incomplete data;
  • Erasure (Art. 17) — request deletion in the circumstances provided by law;
  • Restriction (Art. 18) — request that we limit processing;
  • Portability (Art. 20) — receive your data in a structured, commonly used, machine-readable format;
  • Objection (Art. 21) — object to processing based on legitimate interests; you may object to direct marketing at any time, without giving reasons, and we will stop;
  • Withdraw consent (Art. 7) — at any time, without affecting the lawfulness of processing before withdrawal.

To exercise your rights, email info@remcotools.com. We respond within one month (extendable by two months for complex requests, in which case we will inform you). Exercising your rights is free of charge. We may ask you to confirm your identity where reasonably necessary.

Complaints. You have the right to lodge a complaint with a supervisory authority, in particular in the EU member state of your habitual residence or workplace. Our lead authority is the Belgian Data Protection Authority:

UK customers may complain to the ICO (ico.org.uk); Swiss customers to the FDPIC (edoeb.admin.ch); Norwegian customers to Datatilsynet (datatilsynet.no).

9. Children

The Site is not directed to children under 16, and we do not knowingly process personal data of children under 16 without parental consent. If you believe a child has provided us data, contact us and we will delete it.

10. Changes to This Policy

We may update this Policy from time to time. The "Last Updated" date shows the latest revision. For material changes, we will notify you by email or a prominent notice on the Site before the changes take effect. Updates to this notice do not retroactively change the legal basis of past processing.
